Infant Formula Lawsuit

Many parents are taking legal action against baby formula manufacturers, Abbot Laboratories (Similac) and Mead Johnson (Enfamil). These large companies are being held accountable for failing to disclose their products' risks to both families and medical professionals.

NEC could have been prevented if manufacturers had had the appropriate warnings on their product. If your premature child was given cow-based formula such as Enfamil or Similac and then developed NEC you could qualify for compensation.

What is NEC?

Children's Hospital Los Angeles describes NEC as a devastating disease that affects mostly the intestine of premature infants. The wall of the intestine is invaded by bacteria, which cause local infection and inflammation that can ultimately destroy the wall of the bowel (intestine). Such bowel wall destruction can lead to perforation of the intestine and spillage of stool into the infant's abdomen, which can result in an overwhelming infection and death.

Due to premature babies not having fully developed organs, they cannot break down the cows milk, causing distrubtion in digestion, bleeding, abnormal heart rate or blood pressure and death. Manufacturers Similac and Enfamil are to be blamed for not warning doctors and families properly about their formula being too risky for premature babies to use.

It is thought that premature babies are 10 times more likely to develop NEC than other babies.

The smaller the infant or the more premature the delivery, the greater risk of developing NEC

With over 380,000 premature babies born every year, families and doctors rely on companies to give warnings for any risks that may occur especially when it comes to children.
